Terms of sale

Article 1 – Purpose and Scope

These General Terms and Conditions of Sale (hereinafter "Terms") apply to all sales concluded via the website  enigmatica.fr with consumer customers (hereinafter the "Customer"). They apply to the purchase of:

  • Physical products (code padlocks for bottles).
  • Intangible digital content (access to digital adventures and puzzles).

The acquisition of a product or service through this site implies unreserved acceptance by the Customer of these Terms, which they acknowledge having consulted prior to their order. The company  Enigmatica (hereinafter the "Seller") reserves the right to modify its Terms at any time. The applicable Terms are those in force on the date of the order by the Customer.

Article 3 – Products and Services

The products and services offered are those appearing on the site  enigmatica.fr subject to availability. The Seller takes great care in the presentation and description of these products to best inform the Customer (photographs, characteristics). However, non-substantial errors or omissions may exist, which the Customer acknowledges and accepts.

Regarding digital adventures, the Customer purchases dematerialized access (via a code, a link, or an interface). The proper functioning of the adventure requires a connected device (smartphone, tablet, or computer) with internet access, which is the Customer's responsibility.

Article 4 – Price

Prices shown on product pages are expressed in Euros (€) including all taxes (TTC). VAT not applicable, art. 293 B of the CGI. Enigmatica reserves the right to modify its prices at any time. However, the price indicated at the time of order validation will be the only one applicable to the Customer. For physical products (padlocks), prices do not include delivery costs, which are charged extra and indicated before final validation of the order.

Article 5 – Orders and Payment

Order validation implies acceptance of these Terms, acknowledgment of full awareness thereof, and waiver of the right to rely on one's own terms of purchase. Payment is due immediately upon ordering. Payment for purchases is made by credit card via a secure system. The order will only be considered final after receipt of payment confirmation from our banking provider.

Article 6 – Delivery of physical products

Delivery is only made after confirmation of payment by the Seller's banking institution. Physical products are delivered to the address indicated by the Customer during the ordering process. Delivery times are provided for information purposes only. In the event of a shipping delay, an email will be sent to the Customer. If the delay exceeds 30 days after the conclusion of the contract, the Customer may request the cancellation of the sale and obtain a refund. Risk transfer (loss or damage) occurs when the Customer (or a third party designated by them) takes physical possession of the products.

Article 7 – Access to digital content

For dematerialized products (interactive adventures), upon payment validation, the Customer receives access to the content immediately or deferred (via email or through their customer area). The Seller agrees to make the content accessible once the order is validated, except in cases of force majeure or technical server failure.

Article 8 – Right of Withdrawal

8.1 For physical products (Padlocks): In accordance with the provisions of Article L.221-18 of the French Consumer Code, the Customer has 14 clear days to exercise their right of withdrawal without having to provide a reason or pay penalties, except for return costs which remain their responsibility. The period runs from the receipt of the product. The product must be returned in its original packaging, in perfect condition. After verification, the Seller will issue the refund within 14 days.

8.2 Exception for digital content (Interactive adventures): In accordance with Article L.221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a physical medium whose execution has begun after the consumer's express prior agreement and express waiver of their right of withdrawal. By validating the purchase of an interactive adventure and accessing the digital content, the Customer expressly accepts that the supply begins immediately and thereby waives their 14-day right of withdrawal.

Article 9 – Legal Warranties

All physical products provided by the Seller benefit from the legal warranty of conformity (Articles L.217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). In the event of non-conformity of a sold product (defective padlock), it may be returned to the Seller who will take it back, exchange it, or refund it. All claims, exchange or refund requests must be made by email to contact@enigmatica.fr within 30 days after delivery.

Article 10 – Intellectual Property

All elements of the  enigmatica.fr site and the concepts of the games/puzzles sold remain the exclusive intellectual property of the Seller. No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site (scenarios, videos, texts, visuals). The purchase of a digital adventure confers a strictly personal and non-transferable right of use. It is strictly forbidden to share access codes, solutions, or to reproduce the content for commercial or public use.

Article 11 – Personal Data

The personal data requested from the Customer is necessary for processing their order and establishing invoices. This data is processed in compliance with the provisions of the French Data Protection Act and the GDPR. The Customer has a right of access, modification, and opposition to information concerning them by writing to  contact@enigmatica.fr.

Article 12 – Disputes and Mediation

These Terms are subject to French law. In the event of a dispute, the Customer shall first contact the Seller to obtain an amicable solution. In accordance with the provisions of the Consumer Code regarding the amicable settlement of disputes, the consumer Customer may use a mediation service for free. Failing an amicable resolution, French courts shall have exclusive jurisdiction.
